 Obtain a spanish lawyer
A local lawyer (Abogado) is required to purchase property in Spain. Your lawyer will carry out all necessary searches and check if there are any costs outstanding or encumbrances on the property.

He will obtain absolute proof of ownership from the Property Registry Office, Registro de la Propiedad. A nota simple, an extract from the title, should be obtained from the Registery Office.

All property in Spain is registered in the Registro de Propiedad where you will see who owns the property, the exact size of the property and if there are any mortgages or encumberances on it. Only the people named on the title deed have the right to sell the property. You must seek legal advice as the Spanish law system is complex.

A lawyer will usually charge approximately 1% + any out of pocket expenses and VAT, (known as IVA), which is money well spent for peace of mind. The lawyer will usually tell you in advance what the fee will be.
